1. Legal Status

This document is an electronic record under the provisions of the Information Technology Act, 2000 and relevant rules, including amended provisions pertaining to electronic records across various statutes.

It is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which requires publishing rules, regulations, privacy policy, and Terms of Use for access or usage of the domain name https://saritacabs.com (Sarita Cab Services Private Limited, Mumbai), including its mobile site and/or mobile application (hereinafter referred to as the “Platform”).

2. Agreement to Terms

By accessing or using the Platform and its services or tools, you agree to be bound by these Terms of Use, which include any applicable policies incorporated by reference. If you transact on the Platform, you are also subject to applicable transaction-specific policies.

By mere use of the Platform, you are deemed to have entered into a binding agreement with the Platform Owner. These Terms of Use govern your access to and use of the Platform, as well as the goods and/or services (collectively referred to as “Services”) provided.

Any additional or conflicting terms proposed by you are expressly rejected and shall not be enforceable.

These Terms may be updated at any time without prior notice. It is your responsibility to review them periodically to remain informed of any changes.

3. Definitions

For the purpose of these Terms, the terms “you”, “your”, or “user” shall refer to any individual or legal entity that has agreed to use or purchase services on the Platform.

5. Conditions of Use

By using the Platform and availing Services, you agree to the following:

  4. All content on the Platform is proprietary to or licensed by us. You may not claim any intellectual property rights over its contents, including but not limited to layout, graphics, design, or user interface.
  5. Unauthorized use of the Platform or Services may result in legal action as per applicable laws and these Terms.
  6. You agree to pay any applicable charges or fees for availing the Services.
  7. You shall not use the Platform or Services for any unlawful or prohibited activity under these Terms or Indian/local laws.

  9. Initiating a transaction on the Platform constitutes a legally binding agreement with the Platform Owner for the Services.
  10. You agree to indemnify and hold harmless the Platform Owner, its affiliates, and their officers, agents, employees, and directors from any third-party claims, losses, liabilities, penalties, or damages (including attorney’s fees) arising from your breach of these Terms, applicable laws, or infringement of third-party rights.
  11. We shall not be liable for any delay or failure in performance resulting from a force majeure event including but not limited to natural disasters, war, civil unrest, technical issues, or government actions.
  12. These Terms of Use shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Mumbai, Maharashtra.
